Retail group against revised card settlement | Business | KBOI 2 ...

WASHINGTON (AP) ? A proposed settlement in a class-action lawsuit brought by retailers and trade groups against Visa Inc. and MasterCard Inc. fails to protect merchants from abuse by credit card companies, a national retail group says.

The lawsuit, which dates to 2005, centers on the subject of swipe fees ? charges banks collect every time a Visa or MasterCard is used to pay for a purchase.

The proposed settlement terms, initially disclosed in July, were revised and filed Friday with U.S. District Court in Brooklyn.

But changes to the deal failed to win over many of the retailers represented by the National Retail Federation.

In a statement Mallory Duncan, the trade group's general counsel, said that the proposed deal does virtually nothing to protect retailers or their customers, and it attempts to silence any objections for years to come.

"Retailers would rather take their chances in court than accept this one-sided swindle written by the card industry for the card industry," he added.

The National Retail Federation, the nation's largest retail trade group, is not a party to the lawsuit.

In a statement Friday, Visa called the settlement a fair and reasonable compromise.

Under the proposed settlement, stores will be allowed to charge customers more if they pay with a credit card. The pact covers only U.S. transactions.

Ten of the 19 retailers and trade associations that are plaintiffs in the suit against the credit card companies have sought to block the deal. They contend that the settlement will not stop swipe fees from continuing to rise, hurting both retailers and shoppers, and that it will prevent any future legal challenges.

CIA found militant links a day after Libya attack

WASHINGTON (AP) ? The CIA station chief in Libya reported to Washington within 24 hours of last month's deadly attack on the U.S. Consulate that there was evidence it was carried out by militants, not a spontaneous mob upset about an American-made video ridiculing Islam's Prophet Muhammad, U.S. officials have told The Associated Press.

It is unclear who, if anyone, saw the cable outside the CIA at that point and how high up in the agency the information went. The Obama administration maintained publicly for a week that the attack on the diplomatic mission in Benghazi that killed U.S. Ambassador Chris Stevens and three other Americans was a result of the mobs that staged less-deadly protests across the Muslim world around the 11th anniversary of the 9/11 terror attacks on the U.S.

Those statements have become highly charged political fodder as the presidential election approaches. A Republican-led House committee questioned State Department officials for hours about what GOP lawmakers said was lax security at the consulate, given the growth of extremist Islamic militants in North Africa.

And in their debate on Tuesday, President Barack Obama and Republican challenger Mitt Romney argued over when Obama first said it was a terror attack. In his Rose Garden address the morning after the killings, Obama said, "No acts of terror will ever shake the resolve of this great nation, alter that character or eclipse the light of the values that we stand for."

But Republicans say he was speaking generally and didn't specifically call the Benghazi attack a terror attack until weeks later, with the president and other key members of his administration referring at first to the anti-Muslim movie circulating on the Internet as a precipitating event.

Now congressional intelligence committees are demanding documents to show what the spy agencies knew and when, before, during and after the attacks.

The White House now says the attack probably was carried out by an al Qaida-linked group, with no public demonstration beforehand. Secretary of State Hillary Rodham Clinton blamed the "fog of war" for the early conflicting accounts.

The officials who told the AP about the CIA cable spoke anonymously because they were not authorized to release such information publicly.

Congressional aides say they expect to get the documents by the end of this week to build a timeline of what the intelligence community knew and compare that to what the White House was telling the public about the attack. That could give Romney ammunition to use in his foreign policy debate with Obama on Monday night.

The two U.S. officials said the CIA station chief in Libya compiled intelligence reports from eyewitnesses within 24 hours of the assault on the consulate that indicated militants launched the violence, using the pretext of demonstrations against U.S. facilities in Egypt against the film to cover their intent. The report from the station chief was written late Wednesday, Sept. 12, and reached intelligence agencies in Washington the next day, intelligence officials said.

Yet, on Saturday of that week, briefing points sent by the CIA to Congress said "demonstrations in Benghazi were spontaneously inspired by the protests at the U.S. Embassy in Cairo and evolved into a direct assault."

The briefing points, obtained by the AP, added: "There are indications that extremists participated in the violent demonstrations" but did not mention eyewitness accounts that blamed militants alone.

Such raw intelligence reports by the CIA on the ground would normally be sent first to analysts at the headquarters in Langley, Va., for vetting and comparing against other intelligence derived from eavesdropping drones and satellite images. Only then would such intelligence generally be shared with the White House and later, Congress, a process that can take hours, or days if the intelligence is coming only from one or two sources who may or may not be trusted.

U.S. intelligence officials say in this case the delay was due in part to the time it took to analyze various conflicting accounts. One official, speaking on condition of anonymity because he wasn't authorized to discuss the incident publicly, explained that "it was clear a group of people gathered that evening" in Benghazi, but that the early question was "whether extremists took over a crowd or they were the crowd."

But that explanation has been met with concern in Congress.

"The early sense from the intelligence community differs from what we are hearing now," Rep. Adam Schiff, D-Calif., said. "It ended up being pretty far afield, so we want to figure out why ... though we don't want to deter the intelligence community from sharing their best first impressions" after such events in the future.

"The intelligence briefings we got a week to 10 days after were consistent with what the administration was saying," said Rep. William Thornberry, R-Texas, a member of the House Intelligence and Armed Services committees. Thornberry would not confirm the existence of the early CIA report but voiced skepticism over how sure intelligence officials, including CIA Director David Petraeus, seemed of their original account when they briefed lawmakers on Capitol Hill.

"How could they be so certain immediately after such events, I just don't know," he said. "That raises suspicions that there was political motivation."

National Security Council spokesman Tommy Vietor declined comment. The Office of the Director of National Intelligence did not respond to requests for comment.

Two officials who witnessed Petraeus' closed-door testimony to lawmakers in the week after the attack said that during questioning he acknowledged that there were some intelligence analysts who disagreed with the conclusion that an unruly mob angry over the video had initiated the violence. But those officials said Petraeus did not mention the CIA's early eyewitness reports. He did warn legislators that the account could change as more intelligence was uncovered, they said, speaking on condition of anonymity because the hearing was closed.

Beyond the question of what was known immediately after the attack, it's also proving difficult to pinpoint those who set the fire that apparently killed Stevens and his communications aide or launched the mortars that killed two ex-Navy SEALs who were working as contract security guards at a fallback location. That delay is prompting lawmakers to question whether the intelligence community has the resources it needs to investigate this attack in particular or to wage the larger fight against al-Qaida in Libya or across Africa.

Intelligence officials say the leading suspected culprit is a local Benghazi militia, Ansar al-Shariah. The group denies responsibility for the attack but is known to have ties to a leading African terror group, al-Qaida in the Islamic Maghreb. Some of its leaders and fighters were spotted by Libyan locals at the consulate during the violence, and intelligence intercepts show the militants were in contact with AQIM militants before and after the attack, one U.S. intelligence official said.

But U.S. intelligence has not been able to match those reported sightings with the faces of attackers caught on security camera recordings during the attack since many U.S. intelligence agents were pulled out of Benghazi in the aftermath of the violence, the two U.S. intelligence officials said.

Nor have they found proof to back up their suspicion that the attack was preplanned, as indicated by the military-style tactics the attackers used, setting up a perimeter of roadblocks around the consulate and the backup compounds, then attacking the main entrance to distract, while sending a larger force to assault the rear.

Clear-cut answers may prove elusive because such an attack is not hard to bring about relatively swiftly with little preplanning or coordination in a post-revolutionary country awash with weapons, where the government is so new it still relies on armed militants to keep the peace. Plus, the location of U.S. diplomat enclaves is an open secret for the locals.

The challenges facing a person who is married to someone with untreated attention deficit hyperactivity disorder (also known as ADD or ADHD) can be difficult to navigate.

These challenges may be completely hidden to the rest of the world. No one seems to understand what you struggle with. Your spouse is such a ?great guy? and may appear ?together? to everyone else.

This article attempts to address some of the predictable patterns that one may experience being married to someone with ADD and why it creates such difficulty.?

Being married to someone with untreated ADD is often fraught with a predictable progressive pattern that goes from happy to confused to angry, and finally, to hopeless. How does this happen and why is this so predictable in couples whose spouses have untreated ADD?

In an attempt to answer that question let?s look at some of the patterns that typically come up in these kinds of relationships.? It is important to recognize the symptoms of ADD, especially if you suspect your relationship might struggle due to this disorder.

In the beginning phase of the courtship between you and your ADD spouse, you may have been completely swept off your feet or ravished with both attention and affection, while being the primary focus of your partner?s life. His ?hyperfocus? on the relationship probably felt intoxicating and romantic. But, this feeling faded over time.

When someone with ADD enters into a new romantic relationship, the initial excitement feels so stimulating to the ADD brain (which is being flooded with adrenaline and endorphins) that it causes the person to completely turn their attention to you. However, this kind of excitement diminishes over time, along with the adrenaline rush as the ADD spouse looks elsewhere for stimulation.

Of course, this is not conscious on his part, and he may not even be aware that this has happened. However, as time goes on, the non-ADD partner may experience the following seven feelings associated with his/her spouse?s need to find stimulation in places outside of the marital relationship:

1. A sense of rejection.?Individuals with ADD may often be distracted and find it difficult to pay attention to their partner. This may lead you to feel neglected or it may be interpreted as disinterest on the part of your spouse.

2. Loneliness.?If your partner seems disinterested in what you are saying or appears to ignore you, it would be easy to understand that one might feel lonely.

3. Feeling ignored.?Partners of individuals with ADD often get the feeling that all their good advice and suggestions are not taken to heart. This may cause the non ? ADD partner to feel ignored, disrespected or offended.

4. Frustration.?The same kinds of problems keep presenting themselves over and over again. It is difficult to understand how you can have discussions around a problem, think that you are being understood and still the same problem persists.

5. Anger.?Resentment and anger become pervasive when one feels disregarded, disrespected, ignored and often alone in the relationship. Some spouses will become irate and scream at their partner, while others will shut down and block all emotions. This will leave a partner in the cold. Either way, one can see how this pattern becomes increasingly destructive.

6. Exhaustion.?As the non-ADD spouse tries to compensate for the lack of equal sharing or follow through in responsibilities, you can often feel depleted. As if no amount of effort seems to resolve these same issues that continue to plague your marriage.

Due to the inconsistency in your spouse?s ability to follow through and remember to do things, the feelings of being burdened with more of your fair share of responsibilities can create more feelings of stress.

7. A sense of hopelessness.?When one?s best effort to resolve these problems go nowhere, the sense of sadness and lack of hope may pervade the relationship and lead to a separation or divorce.?

There is hope. With understanding and knowledge, one can transcend these feelings and find a new way of being in the relationship. Learning all you can about ADD and how it affects your partner is vital. It is important to remember that even though your partner may no longer be hyperfocused on you and your relationship, that does not mean he does not still love you.

Since he probably isn?t even aware that your relationship has changed, he might not understand why you are always so angry and demanding. Your increasing frustration, anger and demands only further damage any chances of communication or intimacy, as your partner feels that he can never please you and that he is not enough.

He might feel unloved. Patterns of frustration and anger can be avoided when both partners understand the way the ADD symptoms are affecting your marriage. You must learn different behaviors to heal these kinds of wounds through education, communication and counseling.

(AP) ? European Union leaders are tussling over how much power they want to cede to central authorities during a summit meeting in Brussels focused on how to ensure their debt crisis never repeats itself.

German Chancellor Angela Merkel is pushing a proposal that the European Union's monetary affairs commissioner should become an enforcer of the bloc's budget rules ? including the power to refuse member countries' proposed spending and tax plans and send them back for changes.

Germany hopes that having a "budget czar" ? a move that's been bandied about for months ? will help keep Europe from repeating past mistakes by stopping governments from overspending and needing expensive bailouts. But some countries, like France, are wary of handing control over their finances to unelected officials in a foreign capital.

"I am astonished that, no sooner does someone make a progressive proposal ... the cry immediately comes that this won't work, Germany is isolated, we can't do it," Merkel said in Parliament ahead of the summit.

President Francois Hollande of France ? increasingly the counterpoint to Germany's weight in the EU ? brushed off the suggestion as simply not on the table at this summit. But Hollande is backing another plan that would also see at least members of the eurozone ? the 17 countries that use the euro as their currency ? hand over a great deal of sovereignty.

"The only decision that we have to take, to confirm, is putting in place a banking union by the end of the year," he said. "The first step is a banking supervisor."

Hollande wants the bank supervisor in place because leaders have agreed that, once there is proper supervision, struggling financial institutions will be able to tap Europe's bailout fund directly. That would be a huge relief to countries like Spain, which are facing the prospect of taking on enormous debts ? and worrying markets in the process ? in order to bail out their banks.

After an apparently unanimous agreement on the need for a supervisor at a summit in June, some European governments ? including Germany, the Netherlands and Finland ? have tried to put the brakes on any decision about a banking union.

That could mean that few concrete decisions will emerge from meetings of the 27 national leaders in Brussels on Thursday and Friday.

Merkel again insisted Thursday that "quality must come before speed" in setting up the bank supervisor.

"There are a lot of very complicated legal questions, and I am not making the issue more difficult than it actually is," Merkel said.

With unemployment in the region at a record 10.5 percent, and growth grinding to a halt around the continent, the back-and-forth is beginning to frustrate some European officials. Jose Manuel Barroso, who is president of the EU's executive arm, the European Commission, criticized the heel-dragging ahead of the meeting.

"There is not all over Europe the same sense of urgency," said Barroso.

With no relief in sight for beleaguered Spain, the question of whether it will ask for a bailout itself will likely be discussed. The government in Madrid said this week that it would decide in the coming weeks ? although it is still hoping it can avoid asking for any kind of aid.

But the political pressure on Spain is great because should investors become convinced that Madrid will not request aid, they may once again sell off the country's bonds, causing its borrowing rates to rise. If Spain were to be locked out of bond markets because of excessively high rates, the 17 countries that make up the eurozone would have to rescue it at huge financial cost.

"It would be helpful ... if Spain asked for ESM (European bailout fund) aid," said Herman Van Rompuy, who is president of the European Council, the body composed of the leaders of all the EU countries. "But it is up to Spain to make up its mind."

Leaders could also discuss Greece, where rioters were pelting police with Molotov cocktails and chunks of marble on Thursday to protest the stringent budget cuts the country has had to implement to secure its rescue loans.

Greece's bailout creditors ? the EU, the International Monetary Fund and the European Central Bank ? have been engaged in tough negotiations in recent weeks over more budget cuts. The group of creditors, known collectively as the troika, has said it won't release the next batch of loans until more savings are made. Without those loans, Greece will default and probably be forced to leave the eurozone.

Budget cuts have been blamed for sinking many countries in Europe into recession and have unleashed protests around the continent.

Van Rompuy said countries were starting to see the first positive effects of austerity, with deficit levels down and borrowing costs falling. But countries "are still suffering a lot," he said. Some 25 million people are without a job in the EU and economic growth prospects are weak.

Long-term proposals for overhauling the EU will likely be key topics of debate in Brussels. They include creating a European budget that could be used to support countries going through deep recessions ? as Spain and Greece are now. That idea appeared in a report Van Rompuy put together for the summit, but has met with some stiff opposition.
